By participating in this Competition, Participant agrees to and accepts these Terms and Conditions of Participation.
2.1 The organizer of the Competition is Creatokia GmbH, Voltastrasse 1, 60486 Frankfurt am Main, Germany, phone +49 69 9072006-0, email: contact(at)creatokia.com (hereinafter: “Organizer”).
2.2 The competition shall be organized exclusively via Organizer’s pages/profiles on Facebook, Instagram, Twitter, Discord and LinkedIn (the “Social Networks”).
2.3 The Competition is neither sponsored, supported, organized nor administered by the providers of the Social Networks. The providers of the Social Networks shall not be responsible for this Competition and will not be available to Participant (clause 3.1) as a contact for this Competition. Organizer shall be the exclusive contact person and responsible party.
3.1 Any natural person aged 18 or over who maintains their own profile on one of the Social Networks is eligible to participate in the Competition (the “Participant”).
3.2 A personal crypto wallet that can receive NFTs of the Ethereum blockchain (e.g. MetaMask) is necessary for the delivery of a Prize (clause 5.1). Participation in the Competition is also possible without such crypto wallet; in this case, clause 5.3 applies to the claiming of a Prize.
3.3 Participant may participate only in their own name. Joint participation is not permitted. Each Participant may only participate in the competition once; multiple entries are not permitted.
3.4 Employees as well as Household Members of employees of the Organizer or Bookwire Holding GmbH, Voltastraße 1, 60486 Frankfurt am Main, Germany, or of an affiliated company of Bookwire Holding GmbH, may not participate in the Competition. “Household member” means any person permanently living in the same household as the respective employee.
4.1 Participation in the Competition is free of charge. The purchase of goods or services is not a prerequisite for Participation.
4.2 The period during which participation in the Competition shall be possible (the “Competition Period”) shall begin with the announcement of the Competition on the respective Social Network (the “Competition Posting“). The end of the Competition Period, i.e. the time until which participation is possible, shall be specified in the Competition Posting as well.
4.3 In order to participate, Participant must „like„ (or, if applicable, the equivalent of the respective Social Network), share, comment and tag at least one other person in their comment (“Participation”). The tagged person must have their own page or profile on the same Social Network (clause 2.2) which can be tagged; otherwise this function will not be available.
4.4 Organizer has no control over the error-free operation of the Social Network which Participant utilizes to enter the Competition (clause 4.3). Organizer assumes no responsibility or liability for incomplete, incompletely transmitted, lost or delayed comments.
4.5 Participant may withdraw their Participation at any time until the end of the Competition Period by deleting their comment or their like or their tagging of another person (cf. clause 4.3).
5.1 The prize that Participant may win, i.e. an individually created NFT (the “Prize”), shall be specified in the Competition Posting.
5.2 The Winner(s) shall be determined by random draw (lottery) within 48 hours of the end of the Competition Period and shall be notified on the relevant Social Network by a public posting by Organizer (the “Prize Notification“).
5.3 Claiming the Prize
5.3.1 In order to claim their Prize, Winner must send a private message to Organizer on the relevant Social Network (clause 4.3) within 48 hours of the Prize Notification (the “Response Deadline“), stating the wallet ID of an eligible crypto wallet (clause 3.2).
5.3.2 Should Winner not have an eligible crypto wallet, they may ask Organizer for assistance in creating one. Organizer, however, assumes no warranty for the successful creation of a crypto wallet.
5.3.3 Participant’s “Response” shall mean Participant’s initial response message (clause 5.3.1) an any further private messages by Participant to Organizer on the relevant Social Network stating supplementing information, in particular the wallet ID of a subsequently created crypto wallet (clause 5.3.2).
5.4 The Prize shall be delivered by a so-called „airdrop„ via the Ethereum blockchain, i.e. Organizer shall transfer the Prize to the crypto wallet specified by Winner. The blockchain and its functionalities, such as storing tokens in crypotowallets, are partly beyond Organizer’s control. Organizer therefore assumes no responsibility for the proper functioning of these technologies, but only for the functionalities of the Prize.
5.5 Winner’s claim to a Prize shall be forfeited without compensation in the following cases:
• Winner fails to send their Response within the Response Deadline; or
• Winner does not provide the required information (clause 5.3.1) or does not provide it in full in their Response.
5.6 In the cases referred to in clause 5.5, Organizer will not conduct a further draw.
5.7 Prizes cannot be claimed in cash.
6.1 Organizer reserves the right to terminate the competition prematurely and to disqualify Participants for good cause.
6.2 Good cause for premature termination of the Competition shall be deemed to exist in particular if circumstances arise which mean that it is no longer possible to carry out and complete the Competition on the relevant Social Network (clause 4.3) (e.g. blocking by the provider, disruption of the Social Network, disruption of communication).
6.3 Good cause for disqualifying Participant shall be deemed to exist in case of Participant’s breach of one of their obligations hereunder or any attempt at manipulation, in particular through multiple entry. Participant may be disqualified at any time, even after completion of the Competition. If disqualified, Participant shall lose any claim to their Prize that may already have arisen, and Organizer may reclaim any Prize that may already have been delivered.
7.1 Organizer processes Participant’s personal data for the performance of the Competition including the transfer of a Prize, if any.
7.2 Participant’s personal data will not be processed for any other purpose.
There shall be no legal recourse regarding the determination of Winner(s).
The EU Commission provides a platform for out-of-court online dispute resolution (ODR platform), which can be accessed at https://ec.europa.eu/consumers/odr. Organizer neither commits to nor is obliged to participate in dispute resolution procedures before a consumer alternative dispute resolution entity.
